			<content:encoded><![CDATA[<p>Transocean has settled its first lawsuit filed on behalf of Karl Kleppinger Jr.’s family. Karl was one of the 11 oil rig crew members killed on the night of April 20, 2010, when the Deepwater Horizon drilling rig in the Gulf of Mexico. The terms of the settlement were not disclosed.</p>

<p>Karl Kleppinger Jr.’s family was one of the first to sue over deaths and injuries suffered by the 126 crew members who were on the rig when it blew out while drilling a well for BP Plc off the Louisiana coast. The explosion caused the largest offshore oil spill in U.S. history, with more than 4.1 million barrels of oil spewing into the Gulf of Mexico.<span id="more-871"></span></p>
<p><a href="http://www.bloomberg.com/news/2011-01-13/transocean-settles-first-death-case-from-deepwater-horizon-gulf-disaster.html" target="_blank"></a></p>
<p><a href="http://www.bloomberg.com/news/2011-01-13/transocean-settles-first-death-case-from-deepwater-horizon-gulf-disaster.html" target="_blank">Bloomberg News</a> reports:</p>
<blockquote><p>“The Kleppingers have settled all of their claims arising out of the death of Karl Kleppinger Jr. against any current or possible defendants,” Steve Gordon, the family’s <a title="maritime lawyer" href="http://www.offshoreinjuries.com/CM/Custom/Attorneys.shtml" target="_blank">maritime lawyer,</a> said today in an interview. “The Kleppingers’ claim against BP has concluded.”</p>
<p>The settlement was posted today in the docket of the New Orleans federal court handling suits arising from the explosion. Transocean attorneys and Gordon submitted a court filing asking for dismissal of the suit because of the settlement.</p>
<p>Gordon declined to disclose the amount of the settlement or who would be paying it. The claims are resolved “against all parties they sued or could have sued,” he said.</p>
<p>“The terms are confidential,” Ellen Barry, a Transocean spokeswoman, said in a phone interview today.</p>
<p>Kleppinger was a floor hand on the rig when it exploded.</p>
<p>Closed Chapter</p>
<p>“The Kleppingers have tried to close a very terrible chapter in their lives,” said Gordon, <a title="maritime lawyer" href="http://www.offshoreinjuries.com/" target="_blank">maritime lawyer</a> of Gordon, Elias &amp; Seely LLP in Houston. “It is time to move on.” Gordon also represents Transocean employees who were injured in the explosion. Those cases remain pending, he said.</p>
<p>The Kleppinger suit, filed in Texas state court, was removed to federal court in New Orleans and combined with hundreds of others seeking compensation for injuries and economic damages from the explosion and spill.</p>
<p>Daren Beaudo, a spokesman for BP, declined to comment on the settlement.</p></blockquote>

			<content:encoded><![CDATA[<p>SAN FRANCISCO &#8211; The 9th U.S. Circuit Court of Appeals ruled Friday that prosecutors may not present positive urine samples and other vital evidence that the government says shows that the slugger knowingly used steroids.</p>

<p>Laboratory records alleged to show that former San Francisco Giants slugger Barry Bonds used performance-enhancing drugs are inadmissible in the court case against him, a federal appeals court ruled Friday&#8230; <span id="more-829"></span></p>
<p>The appeals court ruling upholds a lower court decision barring federal prosecutors from showing the jury any evidence collected by Bonds&#8217; personal trainer Greg Anderson.</p>
<p>Anderson last year told the trial court judge that he would rather go to jail on contempt of court charges than testify against Bonds.</p>
<p>The court says evidence tied directly to Anderson is inadmissible &#8220;hearsay&#8221; evidence unless the trainer testifies to the items&#8217; authenticity.</p>
<p>The 2-1 ruling upheld a decision by U.S. District Judge Susan Illston to exclude the drug test log sheets from Bonds’ trial on charges of lying to a federal grand jury about taking steroids and other banned substances.</p>
<p>Illston had ruled that the drug-test records from Bay Area Laboratory Cooperative were connected to Bonds only by hearsay evidence, as the trainer who reportedly submitted the blood and urine for testing has refused to testify that the samples came from Bonds.</p>
<p>The federal government’s appeal of Illston’s ruling delayed Bonds’ trial for more than a year. Legal analysts now suggest the trial itself could be dropped, as prosecutors have been denied the use of what they considered crucial evidence.</p>
<p>“When lawyers have invested a lot of time and emotional capital into a particular case, it is not easy to let go,” said University of San Francisco law professor Robert Talbot. “But it will be pretty hard for them to win. That was key evidence.” The lab results seized during a raid by federal agents impugned more than 100 professional baseball players.</p>
<p>The names of some of the most prominent players were later leaked to news media, including Alex Rodriguez of the New York Yankees, Red Sox slugger David Ortiz and Manny Ramirez, now with the Dodgers. In an earlier ruling by the U.S. 9th Circuit Court of Appeals, the government was told to return the lab records seized in the raid except for the 10 players whose names were on the search warrant. </p>

			<content:encoded><![CDATA[<p>Joran van der Sloot, the suspect in the 2005 disappearance of Alabama teenager Natalee Holloway in Aruba, is now wanted for the killing of a woman in Peru, Peruvian police officials said Wednesday.</p>

<p>The father of the murder girl told Peruvian reporters Wednesday he is certain Dutch national Joran van der Sloot killed his daughter,  21-year-old Stephany Flores Ramirez. Ricardo Flores, a race car driver and well-known businessman in Peru, told reporters, &#8220;This is my daughter&#8217;s assassin.&#8221;&#8230; <span id="more-816"></span></p>
<p>There is &#8220;incriminating evidence&#8221; linking van der Sloot to the killing of 21-year-old Stephany Flores Ramirez, who was found dead in a Lima hotel room Wednesday, Cesar Guardia Vasquez, of the criminal investigations unit said at a news conference. </p>
<p>The hotel room where Flores was found was registered in van der Sloot&#8217;s name, he said.<br />

<p>A hotel guest and an employee witnessed the pair entering the hotel room together at 5 a.m. on Sunday, Guardia said.</p>
<p>Police have video of the previous night, May 29, of van der Sloot and Flores together at the Atlantic City Casino in Lima, he said.</p>
<p>According to immigration officials, van der Sloot fled to Chile over land on Monday, Guardia said.</p>
<p>&#8220;We have all the evidence to show that the killer is this man,&#8221; the victim&#8217;s father, businessman and race-car driver Ricardo Flores told CNN en Español.</p>
<p>But van der Sloot&#8217;s attorney, Joseph Tacopino, told CNN it was too early to make any conclusions.</p>
<p>&#8220;If history teaches us any lesson from van der Sloot/Holloway case, it&#8217;s that there have been way too many false facts that have been leaked and rumors that have been proven untrue,&#8221; Tacopino said. &#8220;We need to take a step back. I have not been contacted and the family has not been contacted. Joran has not been asked by anyone to surrender.&#8221;</p>
<p>Ricardo Flores said that police found his daughter&#8217;s car about 50 blocks from the hotel, and that inside, they found pills like those used in date rape cases.</p>
<p>Similar to the Holloway case, van der Sloot allegedly met at a night spot, in this case, a casino. Ricardo Flores said he did not believe that his daughter knew the Dutch citizen from before.</p>
<p>Both of them speak English, and at the casino they struck up conversation, he said. </p>

<p>According to TMZ the prosecutor Fred Bright said the alleged victim wrote a letter on March 17, in which she stated that she no longer wanted to pursue the case&#8230;<span id="more-793"></span></p>
<p>During his investigation, Bright claims &#8220;everyone&#8221; agreed that both Ben and his accuser were highly intoxicated on March 5 when they went into the bathroom at Capital City nightclub.</p>
<p>Bright said there are still &#8220;significant questions about what occurred&#8221; in the bathroom &#8230; but Ben will not be prosecuted.</p>
<p>Bright said after the alleged incident, the woman went to a local hospital where a doctor and two nurses examined her and found &#8220;a superficial laceration,&#8221; bruising and bleeding in the genital area.</p>
<p>Bright said the woman told doctors &#8220;a boy kinda raped me&#8221; &#8212; but Bright said the doctor could not definitively say if the woman&#8217;s injuries were the result of a sexual assault.</p>
<p>Bright said Ben initially claimed that the woman fell and hit her head in the bathroom &#8212; but after she arrived at the hospital, doctors found no trauma to the woman&#8217;s head. After that, Bright says Ben&#8217;s agent stepped in and said the quarterback wouldn&#8217;t answer questions with an attorney present.</p>

<p>L.A. County Coroner&#8217;s investigators took a picture in the room, showing an empty Propofol bottle on the floor, underneath the nightstand by Jackson&#8217;s bed. The defense will argue Jackson grabbed the bottle from the nightstand, injected himself and then dropped the bottle&#8230; <span id="more-773"></span></p>
<p>Law enforcement believes Dr. Murray hid bottles of Propofol before paramedics arrived. The defense will argue that if Dr. Murray was really hiding Propofol, he would have removed the empty bottle under the nightstand that caused Jackson&#8217;s death.</p>
<p>According to TMZ the defense argument time-line will go as follows:</p>
<ul>
<li>At around 10:50 AM, Dr. Murray gave Jackson 25 mg of Propofol from a 20 ml bottle &#8212; that&#8217;s only about 1/8 of the bottle.</li>
<li>The dose Dr. Murray administered would keep someone asleep for only 5 to 10 minutes, but the Propofol, along with the Ativan and Versed that was already in MJ&#8217;s system, had a synergistic effect that put Jackson to sleep for a longer period of time.</li>
<li>For the next hour, Dr. Murray stayed in the room and was on the phone for much of the time. Dr. Murray didn&#8217;t leave the room to make the calls because MJ liked activity in the room, regularly sleeping with the lights on and cartoons blaring on the TV.</li>
<li>At around noon, Dr. Murray left the room for approximately two minutes to go to the bathroom. While he was gone, the defense believes Jackson suddenly awakened and was frustrated he had spent nearly 9 hours trying in vain to sleep. The defense theory &#8212; Jackson took the 20 ml bottle of Propofol and self-injected the remaining contents through the IV, causing a massive overdose that stopped his heart.</li>
<li>Dr. Murray walked back in the room and saw Jackson with his eyes open and pupils dilated. Dr. Murray dropped the phone (he was speaking with his girlfriend) and began administering CPR.</li>
</ul>
<p>TMZ could not reach Ed Chernoff, Murray&#8217;s lawyer, for comment.</p>

<p>&#8220;While he believes he&#8217;s done nothing illegal in trying to hide his extramarital affair with Rielle and their daughter, he thinks the Feds are going to make an example of him.&#8221;</p>
<p>Edwards, who was exposed recently by the release of Andrew Young&#8217;s tell-all memoir of campaign trail debauchery and details of an Edwards-Hunter sex tape, has recently separated from his cancer stricken wife, Elizabeth.</p>
